Beacon Minds Solutions Private Limited (“Company”, “We”, “Our”) Eunoia (“Service”, “App”) By accessing or using the website and/or the app / services offered under Eunoia, you (“User”, “You”) agree to comply with these Terms of Service. If you do not agree, do not use the Service.

1. Eligibility

1.1 You must be 18 years or older to use Eunoia.

1.2 By using the Service, you confirm that you meet the age requirement and have the legal capacity to agree to these Terms.

2. Service Description

2.1 Eunoia provides an AI-powered Mental Wellness Self-Serve Therapy designed to:

  • Help users manage personal life, structure time, improve mental awareness, and shape discipline and character. 
  • Facilitate positive mindset development through AI-assisted interactions, journaling, planning, and task management. 

2.2 The Service does not provide medical advice, diagnosis, or treatment. It is strictly a life assistant for personal mental well-being.

3. User Accounts & Access

3.1 Users may sign up voluntarily using the available login options, including single sign-on (SSO) and two-factor authentication. 

3.2 You are responsible for maintaining the confidentiality of your login credentials and activity on the Service. 

3.3 The Company may provide free daily credits/tokens for use of features, subject to limits set by the App. Exceeding limits may require purchase of additional credits or result in restricted access at the sole discretion of the Company.

4. User Conduct

4.1 Users agree not to engage in conversations or requests with the AI Chat Agent related to: Medicines, drugs, pornography, sex, weapons, or any harmful content.

4.2 The AI Chat Agent and Service reserve the right to refuse, stop, or block responses to inappropriate or harmful topics.

4.3 Users shall use the Service responsibly and in compliance with applicable laws.

5. Data Collection, Processing & Explicit User Consent, Data Security & Retention,

5.1 The Service may collect and process personal, professional, educational, behavioral, and general information necessary for providing and improving the Service.

5.2 Explicit and Voluntary Consent: 
By using the Service, you expressly acknowledge and agree that: 

    • Any information, data, text, audio, or inputs that you provide by typing or voice dictation into the Service is given voluntarily and with your explicit consent. 
    • This includes inputs provided to:
      • The AI Chat Agent and Human Therapy Professionals, 
      • The AI Mental Wellness Indicator Assessment, 
      • Journals, 
      • Planner and task management features. 

5.3 You understand and agree that such inputs may be collected, processed, analyzed, and stored by the Company to:

  • Provide personalized insights and responses, 
  • Improve Service functionality and user experience, 
  • Enhance AI models and system performance. 

5.4 You confirm that you are solely responsible for the information you choose to provide and that such submission is done knowingly, willingly, and without coercion.

5.5  Users consent to the collection and use of such information in accordance with applicable Indian Data Privacy and Protection Laws.

5.6 Users have the right to request deletion of their account and data at any time. Upon deletion, the user will lose all access to their data permanently.

  • Service delivery

  • Data will be permanently removed (subject to legal retention requirements) 
  • Access to the Service will be terminated 
6. Company Rights & Termination

6.1 The Company reserves the right to suspend, block, or terminate accounts at its discretion for:

  • Violations of these Terms, 
  • Misuse of the Service, 
  • Any other reasons deemed necessary by the Company. 

6.2 The Company may delete user data related to terminated accounts.

7. Limitations of Liability

7.1 The Service is provided “as is” and without any warranties. 

7.2 The Company is not liable for any losses, damages, or consequences arising from the use of the Service, including reliance on AI interactions.

7.3 Users understand that Eunoia is not a substitute for professional medical or psychological care.

8. Payments & Credits

8.1 Certain features may require purchase of additional plans, credits or tokens.

8.2 All payments are non-refundable unless otherwise stated.

8.3 Pricing and availability of credits/tokens are subject to change at the Company’s discretion.

9. Intellectual Property

9.1 All content, AI models, software, designs, and intellectual property in the Service are owned by the Company. 

9.2  Users may not copy, reproduce, distribute, or create derivative works without explicit permission. 

10. Governing Law & Jurisdiction

10.1 These Terms shall be governed by the laws of India. 

10.2 Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, India. 

11. Amendments

11.1 The Company may update or modify these Terms at any time.

11.2 Users will be notified of significant changes via the App or email. Continued use constitutes acceptance of the updated Terms.
